Terms of Service for BrainBeats

1. Introduction

Welcome to BrainBeats ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, located at https://brainbeatsapp.com, our mobile applications, and our PDF-to-video transformation services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Service Description

BrainBeats is a subscription-based mobile application that transforms static study materials (PDFs, notes, documents) into engaging, short-form videos. Our Service uses advanced AI for script generation and text-to-speech conversion paired with client-side video compositing to create 3-minute "beats" that present academic content in a TikTok-inspired format.

3. User Preferences and Storage

BrainBeats does not require account registration. Your preferences and content are stored locally on your device. For iOS users, we offer integration with iCloud for document backup. All user content remains on your device unless you choose to export or share it.

4. Subscription and Payment Terms

4.1 Subscription

Access to our full PDF-to-video transformation service is available through subscription plans. Details of available plans, including pricing and features, are provided in our application and on our website.

4.2 Free Trial

We offer a 3-day free trial for new users. The free trial provides access to all features of our Service. At the end of the trial period, your selected subscription plan will automatically begin unless you cancel before the trial ends.

4.4 Payment

Payment will be charged to your Apple ID/Google account at confirmation of purchase. Subscription automatically renews unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions in your device Account Settings.

4.5 Refund Policy

We do not provide refunds for active subscription periods. Once a subscription period has begun, you will continue to have access to premium features until the end of that period, regardless of when you cancel.

4.6 Restore Purchases

If you've previously purchased a subscription and need to restore access, you can use the "Restore Purchases" option within the app to recover your subscription status.

5. User Content and Ownership

5.1 Ownership of User Content

You retain all rights to the documents you upload to our Service for transformation. BrainBeats does not claim ownership of any documents you provide.

5.2 Local Processing

Documents you upload are processed locally on your device when possible. For advanced processing, content may be sent to AI services with no personal identifiers included.

5.3 Content Export

We provide a custom .bbeats file format for exporting your content for backup or sharing between your devices. Content generated is for personal use only.

6.1 Service Ownership

BrainBeats owns and retains all rights, title, and interest in the Service, including all intellectual property rights related to the BrainBeats platform, software, algorithms, designs, and generated video format.

When you purchase a subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our transformation service for your personal or educational purposes.

7.1 Content Ownership

The background videos used in our Service are owned by BrainBeats or licensed to BrainBeats. Your subscription grants you the right to use these videos as part of the PDF-to-video transformation service but does not transfer ownership of these background videos to you.

7.2 Download and Storage

Our Service may download background videos to your device to enhance performance. These videos remain the property of BrainBeats and may only be used within our application.

8. Data Collection and Privacy

8.2 Local Processing

Documents you upload for transformation are processed locally on your device when possible. For advanced processing, content may be sent to AI services without personal identifiers.

9. Termination

We reserve the right to suspend or terminate your access to the Service, with or without notice, for any violation of these Terms, for any other reason, or for no reason. Upon termination, all content stored within the app remains on your device unless you delete it.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY OF CONTENT PROCESSED OR GENERATED THROUGH THE SERVICE.

11. Limitation of Liability

IN NO EVENT SHALL BRAINBEATS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE DURING THE THREE (3) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY LOSS OF DATA FROM YOUR DEVICE.

12. Apple Standard EULA

For iOS users, this app uses Apple's standard EULA. Please refer to Apple's standard license agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

14. Changes to Terms

We may modify these Terms at any time. If we make material changes to these Terms, we will notify you through the Service. Your continued use of the Service after such notification constitutes your acceptance of the modified Terms.
